Do EU261 and UK261 Laws Cover My Rights?

EU Regulation 261/2004 and Regulation UK-261 are essential European sets of rules that preserve all rights of passengers whose flights depart from an EU and UK airport and who have faced issues departing.

Even though Scoot Airlines isn't European, if your flight was departing from an EU and UK airport, you can claim Scoot Airlines delayed or cancelled flight compensation.

When Can I Claim Compensation from Scoot Airline?

According to EU Regulation 261/2004 and Regulation UK-261, travellers who experience a Scoot flight delay of more than 3 hours or a cancellation may be eligible for compensation. What Is the Time Limit of Compensation Claim?

You have up to six years to get in touch with Scoot Airlines to get your refund and compensation if your flight departs from the UK. The time limit for other European countries may vary. For example, it is 5 years in France and Spain, 3 years in Germany and 2 years in Italy.

Does Scoot Compensate for Delayed Flights?

For you to be eligible for Scoots delayed flight compensation, your flight should be:

  • Delayed by at least 3 hours or more.
  • Departing from an airport in Europe and UK

When Am I Not Eligible for Scoot Delayed Flight Compensation?

Even though EC 261 and UK-261 are the most comprehensive air passenger rights laws in the world, not all flights that are disrupted qualify for flight delay reimbursement from Scoot Airlines.

As previously mentioned, the coverage is limited to Scoot Airlines flight delays that happen when the aircraft is taking off from an EU and UK airport. EC 261 and UK261 do not offer coverage if the departure airport of your flight is outside of the EU and UK.

Also, when your flight delay doesn’t exceed 3 hours delay, you don’t have the right to claim any reimbursement from Scoot Airline even though the issues were their responsibility.

Another exception to mention is that if the flight was delayed due to some extraordinary circumstances, Scoot doesn’t have to pay you any refunds as the interruption is not considered the airline's fault.

What Are These Extraordinary Circumstances?

  • Air traffic controller restrictions (such as runway closure),
  • Political and social instability,
  • Airport security dangers and risks,
  • Bad weather,
  • Strikes at airports or unions,
  • Bird strikes.

However, it's crucial to remember that strikes carried out by airline workers are not seen as extraordinary circumstances because the airline is held responsible for its staff's behavior. Also, when your flight faces technical problems, you can claim refunds as it is the responsibility of each airline to maintain the functionality and condition of its aircraft.

What To Do When Claiming for Scoot Airlines Compensation?

When you claim for Scoot delayed flight compensation, make sure to ask as many questions as you can while being in the airport regarding the problems your flight is facing. For example, you can ask how long your flight is expected to be delayed and the cause behind the delay, if it hasn’t already been announced.

How Much Compensation Should I Expect to Receive?

When you want to determine exactly how much payment you’re entitled to from Scoot, remember that the distance travelled by your flight is what matters. Though there may be some exceptions and unique circumstances, EC 261 and UK261 have specified certain amounts for each passenger to receive.

    In addition to Scoot reimbursement for any lost time, you are entitled to a full or partial refund of your initial ticket and, if necessary, a return ticket to your point of departure if your delay lasts longer than 5 hours.
  • Up and downgrading
    In case your airline inspected the issue and worked immediately to make it up to you by offering an alternative flight and an upgrade, you will not be entitled to any additional charges. On the other hand, if you get your flight downgraded you can get your fully entitled reimbursement of 30-75% of the original ticket fare.
  • Informing passengers of their rights
    Passengers must be informed by the airline of their rights and the provisions of EC 261 and UK261 to claim their obliged compensations.

What Happens If My Scoot Flight Got Cancelled?

When you’re ready to take your booked flight with Scoot and then you’re informed that your flight is cancelled, you may be offered one of the two following options:

  • a refund of your cancelled flight
  • or the option to rebook on an alternative flight.

In any case, you can reject the alternatives given to you if they feel inconvenient to your travelling plans. Keep in mind that those are some options that your airline offers in trying to make up the distributions it made to avoid paying you any charges.

You are fully free to agree to the proposed flight, ask for another replacement flight, or demand reimbursement if you are not happy with any of the options proposed.

When Scoot Airline Is Obliged to Refund Me?

EU 261 and UK261 Regulation on air passenger rights is clear: if you are informed of your flight cancellation less than 14 days before your departure date, you may be entitled to receive up to £520 in compensation.

When Can Scoot Airline Deny My Claim?

This happens if your flight with Scoot was cancelled due to events outside its control, for example personal issues with the airport security, or bad weather. These events are called extraordinary circumstances and, in such cases, the airline doesn’t have to pay you any refunds.

Also, if your airline offered to reschedule your flight to arrive at a similar time to the original one, you’re not entitled to Scoot compensation.

How Much Will I Receive?

The following factors determine how much compensation you are entitled to:

  • When the aircraft was cancelled
  • The flight's distance
  • The flight's arrival time

If your cancelled flight is replaced by the airline and you have to wait a sufficient amount of time, you can ask for the following:

  • Food and drinks
  • Emails and phone calls
  • Transportation from the airport to the hotel and accommodation if you are delayed overnight.

If I Cancel My Scoot Airlines Flight? Can I Get A Refund?

Unfortunately, you mustn’t cancel your Scoot flight for a refund as the tickets are non-refundable and non-cancellable. Scoot Airlines' cancellation policy is restrictive unless you have a flexible fare, which allows you to reschedule your flight to a later date with minimal cost.

There are only three exceptions to this policy.

  • A schedule change or disruption with a retiming of 4 hours or more
  • Medical reasons
  • Death of the passenger or an immediate family member (spouse, child, sibling, parent, grandparent, or grandchild)

  • re-routing as soon as possible,
  • re-routing at a later date at your convenience,

How Much Compensation Can I Claim For My Overbooked Flight?

The distance of the denied flight determines how much compensation you can get. The longer the flight - the larger the compensation you can claim.

If your journey spans less than 1,500km, you could be eligible for €250 or £220. For flights between 1,500 and 3,500km, you could receive €400 or £350. Finally, your denied boarding compensation would rise to €600 or £520 if your trip’s distance exceeds 3,500km.

About  Scoot

Scoot is a low-cost long-haul subsidiary airline of Singapore Airlines (SIA). Established by Singapore Airlines in 2011, Scoot commenced operations in June 2012 in Sydney and Gold Coast.

SIA utilized Scoot to leverage the rising challenge from LCCs in key markets. Scoot initially launched operations with four Boeing 777-200s in a two-class configuration and later switched its fleet to over 15 787-8/9 aircraft, all sourced through parent SIA. Tiger Airways Holdings became a subsidiary of the Singapore Airlines Group in December 2014 after the airline group increased its stake in the company from 40% to 56%.

Singapore Airlines acquired the remaining shares in Tiger Airways Holdings in March 2016 and established a new holding group for its LCC subsidiaries (Scoot and Tigerair) called Budget Aviation Holdings, with plans to merge Scoot into Tiger Airways Holdings. Scoot and Tigerair completed the integration on 25 July 2017.

The combined airline operates A320 and Boeing 787 aircraft under a common AOC, using the Scoot brand and TR flight code. Scoot Tigerair Pte. Ltd. officially changed to Scoot Pte. Ltd. with effect from 31-Mar-2022.
